Conditions Requiring Submission of Specimen
(a)
A magistrate may require as a condition of release on bail or bond of a defendant that the defendant provide to a local law enforcement agency one or more specimens for the purpose of creating a DNA record under Subchapter G (Definitions), Chapter 411 (Department of Public Safety of the State of Texas), Government Code.(b)
A magistrate shall require as a condition of release on bail or bond of a defendant described by Section 411.1471 (Dna Records of Persons Arrested for or Convicted of Certain Offenses)(a), Government Code, that the defendant provide to a local law enforcement agency one or more specimens for the purpose of creating a DNA record under Subchapter G (Definitions), Chapter 411 (Department of Public Safety of the State of Texas), Government Code.(b)
