Development Agreement Required
(a)
The temporary directors may not hold an election under Section 8341.003 (Confirmation and Directors’ Election Required) until a development agreement, as described by Section 212.172 (Development Agreement), Local Government Code, covering the land described by Section 2 of the Act creating this chapter, is executed by the owners of the land covered by the development agreement and by the City of Greenville.(b)
The district may not annex land until:(1)
the land proposed for annexation is covered by a development agreement executed by the owners of the land and the City of Greenville; or(2)
the governing bodies of the City of Greenville and Hunt County consent by ordinance or resolution to the annexation.(c)
Notwithstanding the requirement under Section 212.172 (Development Agreement)(b), Local Government Code, that a development agreement apply only to land located in the extraterritorial jurisdiction of a municipality, a development agreement described by this section may cover land outside the extraterritorial jurisdiction of the City of Greenville.(d)
Section 212.172 (Development Agreement)(d), Local Government Code, does not apply to a development agreement described by this section, and the term of the development agreement may be renewed or extended as mutually agreed to by the owners of the land covered by the agreement and the City of Greenville.
