Occupational License Required


(a)

Except as provided by this section, a person, other than as a spectator or as a person placing a wager, may not participate in pari-mutuel racing activities or wagering without first obtaining a license from the commission. A person may not engage in any occupation for which commission rules require a license under this subtitle without first obtaining a license from the commission.

(b)

The commission shall determine the occupations that afford an opportunity to influence racing with pari-mutuel wagering, including individuals who:

(1)

work in an occupation as an employee, contractor, or volunteer to afford the individual an opportunity to influence racing with pari-mutuel wagering; or

(2)

will likely have significant access to the backside of a racetrack or to restricted areas of the frontside of a racetrack.

(c)

Notwithstanding Subsection (b), the following individuals require a criminal history background check before an occupational license is issued: commissioners, regulatory employees and contractors hired by the commission, racetrack association employees, training facility employees, and employees of either a recognized horseman’s organization or licensed racehorse owners.
