Background Check

The commission shall require a complete personal, financial, and business background check of the applicant or of any person who owns an interest in or exercises control over an applicant for a racetrack license, including the partners, stockholders, concessionaires, management personnel, management firms, and creditors.

The commission shall refuse to issue or renew a license if, in the commission’s sole discretion, the background checks reveal anything that may be detrimental to the public interest or the racing industry.

The commission may not hold a hearing on the application, or any part of the application, of a racetrack license applicant before the 14th day after the date the completed background check of the applicant has been on file with the commission.
