Tex. Water Code Section 62.316
Permanent Commission Organization Following Annexation

(a)

After the expiration and termination of the terms of commission members as provided for in Section 62.314 (Additional Commission Members) of this code, the commission shall be organized as provided by this section.

(b)

The commission shall be managed, governed, and controlled by five commission members.

(c)

The commissioners courts of the county of the annexing district and of the annexed county shall each, by majority vote, appoint two commission members for a term of two years.

(d)

At the expiration of the term of office of each commission member, the commissioners court which appointed that member shall, by majority vote, appoint a successor for a term of two years.

(e)

The fifth commission member shall be chairman and shall serve for a term of two years. He shall be selected by a majority vote of the board of the district and appointed by the board.

(f)

If any vacancy occurs through the death, resignation, or otherwise of any commission member, it shall be filled as in the first instance by appointment for the unexpired term.
