Tex. Labor Code Section 62.154
Domestic Employment


An employer is exempt from this chapter with respect to the employment of a person who:

(1)

performs domestic services in or about a private home, including a person who performs the duties of baby-sitting in or out of the employer’s home; or

(2)

lives in or about a private home and furnishes personal care for a resident of the home.
