Tex. Labor Code Section 62.153
Employment of Certain Professionals, Salespersons, and Public Officials


An employer is exempt from this chapter with respect to the employment of a person:

(1)

employed in a bona fide executive, administrative, or professional capacity;

(2)

employed as an outside salesperson or collector and paid a commission; or

(3)

who performs services for a political subdivision as an elected official or as a member of a legislative body.
