Lists of Arbitrators
(a)
The division shall establish regional lists of arbitrators who meet the qualifications prescribed under Sections 410.102 (Arbitrators; Qualifications)(a) and (b). Each regional list shall be initially prepared in a random name order, and subsequent additions to a list shall be added chronologically.(b)
The commissioner shall review the lists of arbitrators annually and determine if each arbitrator is fair and impartial and makes awards that are consistent with and in accordance with this subtitle and the rules of the commissioner. The commissioner shall remove an arbitrator if, after the review, the commissioner determines that the arbitrator is not fair and impartial or does not make awards consistent with this subtitle and commissioner rules.(c)
The division’s lists are confidential and are not subject to disclosure under Chapter 552 (Public Information), Government Code. The lists may not be revealed by any division employee to any person who is not a division employee. The lists are exempt from discovery in civil litigation unless the party seeking the discovery establishes reasonable cause to believe that a violation of the requirements of this section or Section 410.106 (Selection of Arbitrator), 410.107 (Assignment of Arbitrator), 410.108 (Rejection of Arbitrator), or 410.109 (Scheduling of Arbitration)(b) occurred and that the violation is relevant to the issues in dispute.
