Tex. Health & Safety Code Section 314A.002
Applicability

This chapter applies only to a merger agreement among hospitals each of which is located within a county that:

(1)

contains two or more hospitals; and

(2)

has a population of:

(A)

less than 100,000 and is not adjacent to a county with a population of 250,000 or more; or

(B)

more than 100,000 and less than 150,000 and is not adjacent to a county with a population of 100,000 or more.
