Tex. Health & Safety Code Section 314A.051
Review and Certification of Merger Agreements Required

(a)

Two or more hospitals may negotiate and enter into a merger agreement, subject to approval by the designated agency as provided by this subchapter.

(b)

No merger agreement shall receive immunity under this chapter unless the designated agency issues a certificate of public advantage governing the merger agreement.
