Sec. § 54.804
Order Adopting Plans for Defined Area or Designated Property


After the hearing is completed, the board may approve the proposed plans for the defined area or designated property or may modify the proposed plans.


If the board adopts a proposed plan, it must adopt the definition or designation that it finds, according to the evidence before the board, most equitably distributes the cost of facilities or service and protects the public welfare.


If the proposal includes the issuance of bonds or the imposition of a maintenance tax for the defined area or designated property, the board shall call and hold an election in the defined area or within the boundaries of the designated property only.


The boards order is not subject to judicial review except on the ground of fraud, palpable error, or arbitrary and confiscatory abuse of discretion.
