Transfer of Groundwater out of District


(a)

The district by rule may require a person to obtain a permit from the district for the transfer of groundwater out of the district consistent with Section 36.122 (Transfer of Groundwater out of District), Water Code, and may regulate the terms on which a permit holder under those rules may conduct such a transfer.

(b)

A retail public utility as defined by Section 13.002 (Definitions), Water Code, is not required to obtain a permit to transfer groundwater out of the district if:

(1)

the source of the water is one or more wells located within the district; and

(2)

the water is used by the retail public utility to provide retail water utility service, as defined by Section 13.002 (Definitions), Water Code, in a service area located in a county adjacent to the district.
