City Consent and Development Agreement Execution Required

The initial directors may not hold an election under Section 3954.007 (Confirmation and Directors’ Election Required) until the city has:

(1)

consented by ordinance or resolution to the creation of the district and to the inclusion of land in the district; and

(2)

entered into a development agreement with the owners of the real property in the district under Section 212.172 (Development Agreement), Local Government Code.
