Occ. Code Section 801.052
Membership Eligibility
(a)
A person is eligible for appointment as a veterinarian member of the board if the person:(1)
has resided and practiced veterinary medicine in this state for the six years preceding the date of appointment;(2)
is of good repute; and(3)
is not the holder of a special license issued under Section 801.256 (Special License to Practice Veterinary Medicine).(b)
A person is not eligible for appointment as a public member of the board if the person:(1)
is licensed by an occupational regulatory agency in the field of health care;(2)
is employed by or participates in the management of a business entity or other organization that:(A)
provides health care services;(B)
sells, manufactures, or distributes health care supplies or equipment; or(C)
is regulated by or receives funds from the board;(3)
owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization that:(A)
provides health care services;(B)
sells, manufactures, or distributes health care supplies or equipment; or(C)
is regulated by or receives funds from the board; or(4)
uses or receives a substantial amount of tangible goods, services, or funds from the board, other than compensation or reimbursement authorized by law for board membership, attendance, or expenses.(c)
A person is not eligible for appointment as a public member of the board if the person’s spouse:(1)
is licensed by an occupational regulatory agency in the field of veterinary medicine;(2)
is employed by or participates in the management of a business entity or other organization that:(A)
provides veterinary health care services;(B)
sells, manufactures, or distributes veterinary health care supplies or equipment; or(C)
is regulated by or receives funds from the board;(3)
owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization that:(A)
provides veterinary health care services;(B)
sells, manufactures, or distributes veterinary health care supplies or equipment; or(C)
is regulated by or receives funds from the board; or(4)
uses or receives a substantial amount of tangible goods, services, or funds from the board, other than compensation or reimbursement authorized by law for board membership, attendance, or expenses.
