Tex. Occ. Code Section 551.008
Prohibition on Rule Violating Sincerely Held Religious Belief


(a)

All rules, regulations, or policies adopted by the board may not violate Chapter 110 (Religious Freedom), Civil Practice and Remedies Code.

(b)

A person may assert a violation of Subsection (a) as an affirmative defense in an administrative hearing or as a claim or defense in a judicial proceeding under Chapter 37 (Declaratory Judgments), Civil Practice and Remedies Code.
