Tex. Occ. Code Section 2154.055
Fireworks Safety and Education Program


(a)

The commissioner shall establish a fireworks safety and education program.

(b)

The program:

(1)

shall provide information relating to the proper and safe use of fireworks and the dangers of the improper use of fireworks; and

(2)

may include any method of communicating the need for safe use of fireworks and the dangers of improper use.

(c)

Repealed by Acts 2011, 82nd Leg., R.S., Ch. 1147, Sec. 2.008(16), eff. September 1, 2011.

(d)

To fund the program, in addition to any other license or permit fees:

(1)

the holder of a retail permit issued under Section 2154.202 (Retail Fireworks Permit) shall pay, on issuance or renewal of the permit, a fee in the amount of $10; and

(2)

the holder of a manufacturer’s, distributor’s, or jobber’s license issued under Section 2154.151 (Manufacturer’s License), 2154.152 (Distributor’s License), or 2154.153 (Jobber’s License) shall pay, on issuance or renewal of the license, a fee in the amount of $250.

(e)

Money collected under Subsection (d) may be used only by the commissioner for the purposes of this section.
