Service of Process
(a)
The secretary of state, the secretary’s authorized agent, a sheriff, or a constable may serve a subpoena or summons issued by the secretary of state under Section 2051.401 (Investigative Authority: Subpoena and Summons):(1)
on an individual by:(A)
delivering an executed copy of the subpoena or summons to the individual; or(B)
mailing an executed copy of the subpoena or summons by registered or certified mail, return receipt requested, to the individual’s:(i)
place of residence; or(ii)
principal place of business; and(2)
on an entity by delivering or mailing a duly executed copy of the subpoena or summons to an individual for which service would be appropriate in a civil suit under state law.(b)
Proof of service of process under this section consists of:(1)
a verified return showing the manner of service; or(2)
if the service is made by registered or certified mail, return receipt requested, the return receipt.(c)
By acting as an athlete agent in this state, a nonresident appoints the secretary of state as the nonresident’s agent for service of process in a civil action in this state related to an act by the person as an athlete agent.
