Injunctive Relief; Civil Penalty


(a)

The executive director may institute an action under Section 51.352 (Injunctive Relief; Civil Penalty) for injunctive relief to restrain a violation or a threatened violation of this chapter or an order issued or rule adopted under this chapter.

(b)

In addition to the injunctive relief provided by Subsection (a), the executive director may institute an action for a civil penalty as provided by Section 51.352 (Injunctive Relief; Civil Penalty). The amount of a civil penalty assessed under this section may not exceed:

(1)

$2,500 for each violation; or

(2)

$50,000 in the aggregate for all violations of a similar nature.
