Application of Administrative Procedure Act

(a)

Except as otherwise provided by this title, a hearing conducted under this title is not subject to:

(1)

Section 2001.038 (Declaratory Judgment), Government Code; or

(2)

Subchapters C-H, Chapter 2001 (Administrative Procedure), Government Code.

(b)

A commission order or decision that results from a hearing conducted under this title is not subject to the requirements imposed under:

(1)

Section 2001.004 (Requirement to Adopt Rules of Practice and Index Rules, Orders, and Decisions)(3), Government Code; or

(2)

Section 2001.005 (Rule, Order, or Decision Not Effective Until Indexed), Government Code.
