Tex. Ins. Code Section 912.002
Limited Exemption from Insurance Laws; Applicability of Certain Laws


(a)

A county mutual insurance company is exempt from the operation of all insurance laws of this state except laws that are made applicable by their specific terms or except as specifically provided by this chapter.

(b)

A county mutual insurance company is subject to:

(1)

Sections 38.001 (Inquiries), 401.051 (Duty to Examine Carriers), 401.052 (Frequency of Examination), 401.054-401.062, 401.151 (Expenses of Examination of Domestic Insurer), 401.152 (Expenses of Examination of Other Insurers), 401.155 (Additional Assessments), 401.156 (Deposit and Use of Assessment and Fee), 501.159 (Comments on Certain Insurer Filings), 501.202 (Assessment), 501.203 (Assessment on Property and Casualty Insurers), 822.204 (Form of Capital and Surplus), 1806.001, 1806.101 (Definitions), 1806.103 (Construction of Subchapter)(b), 1806.104-1806.107, 1953.051 (Certain Rating Plans Prohibited)(b), 2002.002 (Lien on Insured Property), and 2002.005 (Coinsurance Clauses);

(2)

Subchapter A, Chapter 86 (Revocation or Modification of Certificate of Authority; Authority to Bring Certain Actions);

(3)

Subchapter A, Chapter 401 (Audits and Examinations);

(4)

the provisions of Subchapter B, Chapter 424 (Investments for Certain Insurers), other than Sections 424.052 (Additional General Investment Authority), 424.072 (Authorized Investments: Bonds Issued, Assumed, or Guaranteed in International Market), and 424.073 (Authorized Investments: Insurer Engaged in Business in Foreign Country);

Chapters 221 (Property and Casualty Insurance Premium Tax), 251 (General Provisions), 252 (Fire and Allied Lines Insurance), 254 (Motor Vehicle Insurance), 541 (Unfair Methods of Competition and Unfair or Deceptive Acts or Practices), and 2210 (Texas Windstorm Insurance Association); and

Articles 5.39 and 5.40.

(c)

Rate regulation for a residential fire and allied lines insurance policy written by a county mutual insurance company is subject to Chapter 2253 (Rating Territories). On and after December 1, 2004, rate regulation for a personal automobile insurance policy and a residential fire and allied lines insurance policy written by a county mutual insurance company is subject to Article 5.13-2 and Chapter 2251 (Rates). A county mutual insurance company is subject to Chapter 2253 (Rating Territories). The commissioner may adopt rules as necessary to implement this subsection.
