Tex. Ins. Code Section 2207.002
Pool Not Engaged in Business of Insurance

(a)

Except as provided by Subsection (b), a pool is not engaged in the business of insurance under this code or other laws of this state, and the department does not have jurisdiction over a pool.

(b)

A pool is subject to Chapter 541 (Unfair Methods of Competition and Unfair or Deceptive Acts or Practices) and Section 543.001 (Misrepresentation Prohibited).
