Tex. Fin. Code Section 180.061
Rulemaking Authority


A rulemaking authority may adopt rules establishing requirements as necessary for:

(1)

conducting background checks by obtaining:

(A)

criminal history information through fingerprint or other databases;

(B)

civil administrative records;

(C)

credit history information; or

(D)

any other information considered necessary by the Nationwide Mortgage Licensing System and Registry;

(2)

payment of fees to apply for or renew licenses through the Nationwide Mortgage Licensing System and Registry;

(3)

setting or resetting, as necessary, license renewal dates or reporting periods;

(4)

amending or surrendering a license or any other activity a regulatory official considers necessary for participation in the Nationwide Mortgage Licensing System and Registry; and

(5)

investigation and examination authority for purposes of investigating a violation or complaint arising under this chapter or for purposes of examining, reviewing, or investigating any license holder or individual subject to this chapter.
