Assessment of Penalty; Restitution Order
(a)
The commissioner may assess an administrative penalty against a person who knowingly and wilfully violates or causes a violation of this chapter, Chapter 394 (Debtor Assistance), or Subtitle B, Title 4, or a rule adopted under this chapter, Chapter 394 (Debtor Assistance), or Subtitle B, Title 4.(a-1)
The commissioner shall assess an administrative penalty against a credit access business who knowingly and wilfully violates or causes a violation of Chapter 393 (Credit Services Organizations), or a rule adopted under Chapter 393 (Credit Services Organizations).(b)
The commissioner may order the following businesses or other persons to pay restitution to an identifiable person:(1)
a person who violates or causes a violation of this chapter, Chapter 394 (Debtor Assistance), or Subtitle B, Title 4, or a rule adopted under this chapter, Chapter 394 (Debtor Assistance), or Subtitle B, Title 4;(2)
a credit access business who violates or causes a violation of Chapter 393 (Credit Services Organizations) or a rule adopted under Chapter 393 (Credit Services Organizations); or(3)
a person who violates or causes a violation of Subchapter B (Definitions), Chapter 1956 (Metal Recycling Entities), Occupations Code, or a rule adopted under that subchapter.
