Sec. § 1001.103
Drug and Alcohol Driving Awareness Programs


In this section, “drug and alcohol driving awareness program” means a course with emphasis on curricula designed to prevent or deter misuse and abuse of controlled substances.


The department shall develop standards for a separate school certification and approve curricula for drug and alcohol driving awareness programs that include one or more courses. Except as provided by commission rule, a program must be offered in the same manner as a driving safety course.


The standards under Subsection (b) may require a course provider to evaluate procedures, projects, techniques, and controls conducted as part of the program.


The department and the Department of State Health Services shall enter into a memorandum of understanding for the interagency approval of the required curricula.


The commission may establish fees in connection with the programs under this section. The fees must be in amounts reasonable and necessary to administer the department’s duties under this section.
