Definitions


In this subchapter:

(1)

“Applicant” means a person who applies to participate in the program.

(1-a)

“Child abduction” means any conduct that:

(A)

constitutes an offense under Sections 20.02 (Unlawful Restraint), 20.03 (Kidnapping), 20.04 (Aggravated Kidnapping), 25.03 (Interference with Child Custody), and 25.031 (Agreement to Abduct from Custody), Penal Code; and

(B)

results in a person younger than 18 years of age becoming a victim of the offense.

(2)

“Family violence” has the meaning assigned by Section 71.004 (Family Violence), Family Code.

(3)

“Family violence shelter center” has the meaning assigned by Section 51.002 (Definitions), Human Resources Code.

(4)

“Household” has the meaning assigned by Section 71.005 (Household), Family Code.

(5)

“Mail” means first class mail and any mail sent by a government agency. The term does not include a package, regardless of size or type of mailing.

(6)

“Participant” means an applicant who is certified for participation in the program.

(7)

“Program” means the address confidentiality program created under this subchapter.

(8)

“Sexual abuse” means any conduct that constitutes an offense under Section 21.02 (Continuous Sexual Abuse of Young Child or Disabled Individual), 21.11 (Indecency with a Child), or 25.02 (Prohibited Sexual Conduct), Penal Code.

(9)

“Sexual assault” means any conduct that constitutes an offense under Section 22.011 (Sexual Assault) or 22.021 (Aggravated Sexual Assault), Penal Code.

(10)

“Stalking” means any conduct that constitutes an offense under Section 42.072 (Stalking), Penal Code.

(11)

“Trafficking of persons” means any conduct that:

(A)

constitutes an offense under Section 20A.02 (Trafficking of Persons), 20A.03 (Continuous Trafficking of Persons), 43.03 (Promotion of Prostitution), 43.031 (Online Promotion of Prostitution), 43.04 (Aggravated Promotion of Prostitution), 43.041 (Aggravated Online Promotion of Prostitution), 43.05 (Compelling Prostitution), 43.25 (Sexual Performance by a Child), 43.251 (Employment Harmful to Children), or 43.26 (Possession or Promotion of Child Pornography), Penal Code; and

(B)

results in a person:
(i)
engaging in forced labor or services; or
(ii)
otherwise becoming a victim of the offense.
