Settlements


(a)

The commission by rule shall adopt procedures governing the use of settlements to resolve contested cases.

(b)

Rules adopted under this section must ensure that:

(1)

each party retains the right to:

(A)

a full hearing before the commission on issues that remain in dispute; and

(B)

judicial review of issues that remain in dispute;

(2)

an issue of fact raised by a nonsettling party may not be waived by a settlement or stipulation of the other parties; and

(3)

a nonsettling party may use an issue of fact raised by that party as the basis for judicial review.
