Tex. Transp. Code Section 286.066
Notice of Application


(a)

On the filing of an application under Section 286.065 (Application for Public Road), the county clerk shall issue to the sheriff or a constable a notice that commands the sheriff or constable to summon the property owners named in the notice to:

(1)

appear at the next regular term of the commissioners court; and

(2)

show cause why the line or route designated in the application should not be declared a public road.

(b)

Notice under this section:

(1)

must contain the substance of the application filed under Section 286.065 (Application for Public Road); and

(2)

shall be served and returned in the same manner and for the same length of time as provided for the service of citation in a civil action in justice court.
