Tex. Transp. Code Section 202.060
Living Logos; Pilot Project


(a)

The commission may adopt rules implementing a pilot project for the leasing of state highway right-of-way, subject to any applicable federal regulation of outdoor advertising, as a location or locations for commercial advertising by means of a floral mosaic living logo.

(b)

Rules adopted under this section shall:

(1)

provide for the award of a lease in a manner that maximizes revenue to the state;

(2)

regulate the content, composition, placement, installation, and maintenance of a floral mosaic living logo;

(3)

set a bond for faithful performance of the lessee;

(4)

provide for the public safety;

(5)

ensure that installation and maintenance of a floral mosaic living logo will not interfere with access to, or be inconsistent with the use of, abutting property; and

(6)

include such other matters as may be necessary to protect the integrity of the involved highway.

(c)

A floral mosaic living logo installed or placed under this section may not contain a message, symbol, or trademark that resembles an official traffic-control device.

(d)

This section applies to state highway right-of-way in a county with a population of 500,000 or more.
