Acquisition, Construction, and Operation of Systems


(a)

The authority may:

(1)

by purchase, gift, lease, contract, or any other legal means, acquire and provide a water treatment or supply system, or any other work, plant, improvement, or facility necessary or convenient to accomplish the purposes of the authority, or any interest in those assets, inside or outside the authority;

(2)

design, finance, or construct a water treatment or supply system, or other supply system, or any other work, plant, improvement, or facility necessary or convenient to accomplish the purposes of the authority, and provide water services inside or outside the authority;

(3)

maintain, operate, lease, or sell a water treatment or supply system, or any other work, plant, improvement, or facility necessary or convenient to accomplish the purposes of the authority, that the authority constructs or acquires inside or outside the authority; or

(4)

contract with a person who owns a water treatment or supply system to operate or maintain the system.

(b)

The authority shall give a person outside the authority, including the City of Houston, the option to contract for available excess capacity of the authority’s water treatment or supply system or, before construction of a water treatment or supply system begins, for additional capacity of the system. The authority must offer a contract that would enable the person to pay for the excess or additional capacity in accordance with the person’s pro rata share of the capital investment and operational and maintenance costs for providing the excess or additional capacity.
