Powers Subject to Development and Operating Agreement

In addition to the other limitations provided by this chapter, the district’s authority to exercise its powers is subject to the terms of the development and operating agreement required under Section 3974.0109 (Consent of Municipality and Development Agreement Required), including the district’s authority to:

(1)

acquire, construct, or finance an improvement project or service under Section 3974.0502 (Money Used for Improvements or Services); and

(2)

issue bonds, notes, certificates of participation, or other obligations under Section 3974.0601 (Bonds and Other Obligations).
