Applicability of Other Law to Certain Contracts

(a)

Subchapter I (Contracts for Construction Work), Chapter 49 (Provisions Applicable to All Districts), Water Code, applies to a district contract for construction work, equipment, materials, or machinery. Notwithstanding the limitations and requirements of Sections 2269.003 (Conflict of Laws; Requirement to Follow Procedures of This Chapter)(a) and 2269.352 (Applicability), Government Code, the district may use any project delivery method described by Subchapter I (Contracts for Construction Work), Chapter 49 (Provisions Applicable to All Districts), Water Code, or Chapter 2269 (Contracting and Delivery Procedures for Construction Projects), Government Code, including a delivery method described by Subchapter H (Definitions), Chapter 2269 (Contracting and Delivery Procedures for Construction Projects), Government Code.

(b)

Sections 375.221 (Applicability of Water Districts Law to Competitive Bidding on Certain Contracts) and 375.223 (Supersedes Other Law), Local Government Code, do not apply to the district.
