Temporary Directors


(a)

On or after the effective date of the Act creating this chapter, the owner or owners of a majority of the assessed value of the real property in the district according to the most recent certified tax appraisal roll for the county may submit a petition to the commission requesting that the commission appoint as temporary directors the five persons named in the petition. On request of the member of the state house of representatives in whose legislative district the largest percentage of the district is located, the owner or owners must include in the petition the name of a person designated by the representative. The commission shall appoint as temporary directors the five persons named in the petition.

(b)

Temporary directors serve until the earlier of:

(1)

the date permanent directors are elected under Section 3916.003 (Confirmation and Directors’ Election Required); or

(2)

the fourth anniversary of the effective date of the Act creating this chapter.

(c)

If permanent directors have not been elected under Section 3916.003 (Confirmation and Directors’ Election Required) and the terms of the temporary directors have expired, successor temporary directors shall be appointed or reappointed as provided by Subsection (d) to serve terms that expire on the earlier of:

(1)

the date permanent directors are elected under Section 3916.003 (Confirmation and Directors’ Election Required); or

(2)

the fourth anniversary of the date of the appointment or reappointment.

(d)

If Subsection (c) applies, the owner or owners of a majority of the assessed value of the real property in the district according to the most recent certified tax appraisal roll for the county may submit a petition to the commission requesting that the commission appoint as successor temporary directors the five persons named in the petition. On request of the member of the state house of representatives in whose legislative district the largest percentage of the district is located, the owner or owners must include in the petition the name of a person designated by the representative. The commission shall appoint as successor temporary directors the five persons named in the petition.
