Temporary Directors


(a)

The temporary board consists of:

(1)

Brent Ratliff;

(2)

George Kutch;

(3)

John Nolan;

(4)

Renee Lorenz; and

(5)

H. C. Ross.

(b)

If a temporary director fails to qualify for office, the temporary directors who have qualified shall appoint a person to fill the vacancy.

(c)

Temporary directors serve until the earlier of:

(1)

the date permanent directors are elected under Section 11002.003 (Confirmation and Directors’ Election Required); or

(2)

the fourth anniversary of the effective date of the Act creating this chapter.

(d)

If permanent directors have not been elected under Section 11002.003 (Confirmation and Directors’ Election Required) and the terms of the temporary directors have expired, successor temporary directors shall be appointed or reappointed as provided by Subsection (e) to serve terms that expire on the earlier of:

(1)

the date permanent directors are elected under Section 11002.003 (Confirmation and Directors’ Election Required); or

(2)

the fourth anniversary of the date of the appointment or reappointment.

(e)

If Subsection (d) applies, the owner or owners of a majority of the assessed value of the real property in the district may submit a petition to the Texas Commission on Environmental Quality requesting that the commission appoint as successor temporary directors the five persons named in the petition. The commission shall appoint as successor temporary directors the five persons named in the petition.
