District Property, Facilities, and Equipment


(a)

The board shall determine:

(1)

the type, number, and location of buildings required to maintain an adequate hospital system; and

(2)

the type of equipment necessary for hospital care.

(b)

The board may:

(1)

acquire real property, facilities, and equipment for the district for use in the hospital system in the manner determined by the board;

(2)

lease to physicians, individuals, companies, corporations, or other legal entities or acquire by lease or by lease-purchase agreement real property, facilities, or equipment for use in the hospital system on terms the board determines are in the best interest of district residents; and

(3)

sell or otherwise dispose of district real property, facilities, or equipment on terms the board determines are in the best interest of district residents.

(c)

The district may acquire equipment for use in the district’s hospital system and mortgage or pledge the acquired property as security for the payment of the purchase price. A contract entered into under this subsection must provide that the entire obligation be retired not later than the fifth anniversary of the date of the contract.
