Transfer, Sale, or Administration of Assets if Election Initiated by Board
(a)
This section, Section 1063.307 (Imposition of Tax and Return of Surplus Taxes), and Section 1063.308 (Report; Dissolution Order) apply to an election called under Section 1063.301 (Dissolution Election; Petition)(a).(b)
If a majority of the votes in the election favor dissolution, the board shall:(1)
transfer the ambulance service and related equipment, any vehicles, and any mobile clinics and related equipment that belong to the district to Montgomery County not later than the 45th day after the date on which the election is held; and(2)
transfer the land, buildings, improvements, equipment not described by Subdivision (1), and other assets that belong to the district to Montgomery County or administer the property, assets, and debts in accordance with Subsection (e) and Sections 1063.307 (Imposition of Tax and Return of Surplus Taxes) and 1063.308 (Report; Dissolution Order).(c)
The county assumes all debts and obligations of the district relating to the ambulance service and related equipment, any vehicles, and any mobile clinics and related equipment at the time of the transfer.(d)
If the district makes the transfer under Subsection (b)(2), the county assumes all debts and obligations of the district relating to those assets at the time of the transfer, and the district is dissolved.(e)
If the board finds that the district is dissolved but does not transfer the land, buildings, improvements, equipment, and other assets to Montgomery County under Subsection (b)(2), the board shall continue to control and administer that property and those assets and the related district debts until all money has been disposed of and all district debts have been paid or settled.(f)
The county shall use all transferred assets to:(1)
pay the outstanding debts and obligations of the district relating to the assets at the time of the transfer; or(2)
provide medical and hospital care for needy county residents.
