Right to Hearing; Administrative Procedure

(a)

A respondent is entitled to a hearing conducted by the State Office of Administrative Hearings if the executive director proposes to deny, suspend, or revoke a license.

(b)

A proceeding under this chapter to deny, suspend, or revoke a license is considered to be a contested case under Chapter 2001 (Administrative Procedure), Government Code.

(c)

The executive director by rule shall prescribe notice procedures for a contested case under this chapter that provide for notice by certified mail with electronic return receipt.

(d)
