Tex. Occ. Code Section 453.352
Procedure for License Denial or Disciplinary Action; Schedule of Sanctions

(a)

A person whose application for a license is denied is entitled to a hearing before the State Office of Administrative Hearings if the applicant submits a written request for a hearing to the board.

(b)

A proceeding to take action under Section 453.351 (Grounds for Denial of License or Discipline of License Holder) or an appeal from the proceeding is a contested case for the purposes of Chapter 2001 (Administrative Procedure), Government Code.

(c)

The State Office of Administrative Hearings shall use the schedule of sanctions adopted by the board by rule for a sanction imposed as the result of a hearing conducted by the office.
