Tex. Occ. Code Section 2501.203
Award of Attorney’s Fees


(a)

A plaintiff who prevails in an action filed under Section 2501.201 (Liability for Damages) is entitled to receive court costs and reasonable and necessary attorney’s fees.

(b)

On finding that an action filed under Section 2501.201 (Liability for Damages) is groundless and was brought in bad faith or for the purpose of harassment, the court may award court costs and reasonable attorney’s fees to the defendant.
