Tex. Occ. Code Section 2035.008
Requirements to Order Election


The commissioners court shall order an election if the petition:

(1)

is filed with the county clerk not later than the 30th day after the date of the petition’s issuance; and

(2)

contains a number of signatures of registered county voters equal to at least five percent of the number of votes cast in the county for all candidates for governor in the most recent gubernatorial general election.
