Tex. Occ. Code Section 2033.013
Touting


(a)

A person commits an offense if, with an intent to deceive and an intent to obtain a benefit, the person knowingly:

(1)

makes a false statement about a horse or greyhound race to another person; or

(2)

offers, agrees to convey, or conveys false information about a horse or greyhound race to another person.

(b)

Except as provided by Subsection (c), an offense under this section is a Class A misdemeanor.

(c)

An offense under this section is a state jail felony if:

(1)

the actor:

(A)

is a license holder under this subtitle or a commission member or employee; and

(B)

knowingly represents that a commission member or employee or a person licensed by the commission is the source of the false information; or

(2)

the false statement or information was contained in racing selection information provided to the public.
