Tex. Occ. Code Section 1202.153
Building Code Amendment: Municipality or Other Political Subdivision


(a)

A municipality or other political subdivision may not require or enforce, as a prerequisite for granting or approving a building or construction permit or certificate of occupancy, an amendment to a code described by Section 1202.151 (Building Codes).

(b)

On the petition of a local building official and after a hearing, the council may require a reasonable amendment to a building code group described by Section 1202.151 (Building Codes)(b)(1) or (2) that the council determines to be essential for public health and safety. The amendment shall be applied uniformly on a statewide basis.
