Tex. Nat. Resources Code Section 115.002
Exception

This chapter does not apply to the retail purchase of a petroleum product if that product is:

(1)

contained in the ordinary equipment of a motor vehicle; and

(2)

used only to operate the motor vehicle in which it is contained.
