Tex. Ins. Code Section 1901.055
Claim Surcharge


A claim surcharge assessed by an insurer against a physician or health care provider under a professional liability insurance policy may be based only on claims actually paid by an insurer as a result of:

(1)

a settlement; or

(2)

an adverse judgment or decision of a court.
