Tex. Ins. Code Section 1508.151
Employer Certification


(a)

At the time of initial application, a health benefit plan issuer shall obtain from a small employer that seeks to purchase a qualifying health benefit plan a written certification that the employer meets the eligibility requirements described by Section 1508.051 (Employer Eligibility to Participate) and the minimum employer participation requirements described by Section 1508.053 (Minimum Employer Participation Requirements).

(b)

Not later than the 90th day before the renewal date of a qualifying health benefit plan, a health benefit plan issuer shall obtain from the small employer that purchased the qualifying health benefit plan a written certification that the employer continues to meet the eligibility requirements described by Section 1508.051 (Employer Eligibility to Participate) and the minimum employer participation requirements described by Section 1508.053 (Minimum Employer Participation Requirements).

(c)

A participating health benefit plan issuer may require a small employer to submit appropriate documentation in support of a certification described by Subsection (a) or (b).
