Applicability of Other Insurance Laws


The following laws apply to a person engaged in the business of life settlements:

(1)

Chapters 82 (Sanctions), 83 (Emergency Cease and Desist Orders), 84 (Administrative Penalties), 101 (Unauthorized Insurance), 481 (Voluntary Deposits), and 701 (Insurance Fraud Investigations);

(2)

Sections 31.002 (Duties of Department), 32.021 (Annual Reports), 32.023 (Reports to Other States), 32.041 (Forms), 38.001 (Inquiries), 81.004 (Report to Attorney General), 86.001 (Authority to Revoke or Modify Certificate of Authority), 86.051 (Authority to Bring Action for or Prosecute Violation of Law), 86.052 (Authority to Bring Action to Close Affairs or Restrain Business of Domestic Insurance Company), 201.004 (Electronic Transfers), 401.051 (Duty to Examine Carriers), 401.054 (Powers Related to Examination), 401.151 (Expenses of Examination of Domestic Insurer)(a), 521.003 (Notification of Complaint Status), 521.004 (Records of Complaints), 543.001 (Misrepresentation Prohibited)(c), 801.056 (Failure to Provide Complete Set of Fingerprints: Ground for Denial of Application), and 862.052 (Prohibitions Relating to Life Insurance and Life Insurance Companies);

(3)

Subchapter A, Chapter 32 (Administrative Powers and Duties);

(4)

Subchapter C, Chapter 36 (Department Rules and Procedures);

(5)

Subchapter B, Chapter 404 (Financial Condition); and

(6)

Subchapter B, Chapter 491 (General Reinsurance Requirements).
