Tex. Election Code Section 213.059
General Election for Governor or Lieutenant Governor


(a)

A recount in a general election for the office of governor or lieutenant governor shall be conducted in the same manner as a recount of a general election for a state office in which the final canvass is made by the governor, except as provided by this section.

(b)

The governor is considered to be the final canvassing authority for the election and the secretary of state’s tabulation of the county election returns is considered to be the declaration of the official result.

(c)

The recount supervisor shall deliver two copies of the report prepared under Section 213.055 (Supervisor’s Report) to the secretary of state. The secretary shall use one copy for the tabulation of the votes after the recount is completed. The secretary shall deliver the other copy to the speaker of the house of representatives.
