Tex. Bus. & Com. Code Section 541.155
Civil Penalty; Injunction


(a)

A person who violates this chapter following the cure period described by Section 541.154 (Notice of Violation of Chapter; Opportunity to Cure) or who breaches a written statement provided to the attorney general under that section is liable for a civil penalty in an amount not to exceed $7,500 for each violation.

(b)

The attorney general may bring an action in the name of this state to:

(1)

recover a civil penalty under this section;

(2)

restrain or enjoin the person from violating this chapter; or

(3)

recover the civil penalty and seek injunctive relief.

(c)

The attorney general may recover reasonable attorney’s fees and other reasonable expenses incurred in investigating and bringing an action under this section.

(d)

The attorney general shall deposit a civil penalty collected under this section in accordance with Section 402.007 (Payment to Treasury; Allocation of Certain Money Received by Attorney General), Government Code.
