Alcoh. Bev. Code Section 32.25
Sales at Temporary Location
(a)
The holder of a private club registration permit may temporarily serve authorized alcoholic beverages at a picnic, celebration, or similar event:(1)
sponsored by:(A)
a political party or political association supporting a candidate for public office or a proposed amendment to the Texas Constitution or other ballot measure;(B)
a charitable or civic organization;(C)
a fraternal organization with a regular membership that has been in continuous existence for more than five years; or(D)
a religious organization; and(2)
that is located in the county where the private club registration permit is issued.(b)
The holder of a private club registration permit may temporarily serve alcoholic beverages under this section not more than two times in each calendar year for the same party, association, or organization.(c)
Distilled spirits served under this section must be purchased from the holder of a local distributor’s permit.(d)
The commission shall adopt rules to implement this section, including rules that:(1)
require the permit holder to notify the commission of the dates on which and location where the permit holder will temporarily offer alcoholic beverages for sale under this section;(2)
establish a procedure to verify the wet or dry status of the location where the permit holder intends to temporarily sell alcoholic beverages under this section;(3)
detail the circumstances when a permit holder may temporarily sell alcoholic beverages under this section with only a notification to the commission and the circumstances that require the commission’s preapproval before a permit holder may temporarily sell alcoholic beverages under this section; and(4)
require the permit holder to provide any other information the commission determines necessary.
