Tex. Alcoh. Bev. Code Section 109.531
Additional Requirements for Application or Renewal of Permit, License, or Certificate by Out-of-state Residents

In addition to any other requirement for a license, permit, or certificate under this code, a person who has not been a citizen of this state for a period of one year preceding the date the person filed an application for a permit, license, or certificate under Chapter 25 (Wine and Malt Beverage Retailer’s Permit), 26, 28 (Mixed Beverage Permit), 29, 30, 32 (Private Club Registration Permit), 48, 50 (Promotional Permit), 69 (Retail Dealer’s On-premise License), 71 (Retail Dealer’s Off-premise License), or 74 (Brewpub License) shall:

(1)

designate an agent, who is a citizen of this state, to represent the person in matters before the commission and to be responsible for the proper conduct of any activity of the licensee or permittee; and

(2)

submit to a criminal history background check.
