Tex. Transp. Code Section 68.065
Board Action on Application

(a)

If an objection to an application for a rate change is not received by any commissioner within the period provided by Section 68.064 (Objection; Hearing)(a), the board shall act on the application without further proceedings.

(b)

If a hearing is held as provided by Section 68.064 (Objection; Hearing), the board shall grant, deny, or modify the application after receipt of the evidence offered by the parties and arguments and briefs requested by the board.
